ALBANY, N.Y. -- New York legislators are considering bills seeking limits on car rental operators' vicarious liability in the state.

The bills, introduced in both the Senate and Assembly, would place a $100,000 limit on civil liability per person, $300,000 limit per incident for personal injury, and $50,000 limit for property damage. When a customer has no insurance, the rental company would be liable for an additional $500,000 for economic damage.

The Assembly bill (A05419), sponsored by Assemblyman Ronald Canestrari (D-Albany, Troy), is now in the Assembly Transportation Committee. The Senate bill (S02477), sponsored by Senator Owen H. Johnson, is in the Senate Transportation Committee.
