HB 585, legislation aimed at increasing Montana’s motor vehicle rental tax from 4% to 6%, was defeated after the House Transportation Committee heard concerns that the bill would affect small businesses and residents rather than out-of-state tourists.
The Truck Renting and Leasing Association board of directors elected a new chairman, officers and a new board for 2013-2014 term and for a new term from 2013-2016.
Effective July 1, ‘gross proceeds’ in Virginia’s 10% motor vehicle rental tax excludes specific charges including cash discounts taken on a rental contract; finance, carrying, and other service charges; charges for motor fuels; charges for optional accidental death insurance and more.
HB 1993 removes parking fines, delivery charges, pickup charges, delivery charges, pass-through charges, transportation charges, third-party service charges and refueling surcharges from the definition of “gross products” included in Virginia’s 10% motor vehicle rental tax.
Another similar bill would make an across-the-board increase to MFR requirements of up to 500% more than currently required for all motor vehicles registered in the state.
Federal legislation to repeal the 12% federal excise tax on truck and trailer purchases and replace it with an increase in the diesel fuel tax was introduced March 29 in the U.S. House of Representatives.
The bill, HB 322, was introduced Jan. 11 and would attempt to expand the definition of "gross proceeds" as they relate to the collection of the rental tax.
Feeling the pressure from the lobbying effort of the industry and acknowledging the controversial nature of the issue, Sen. Barbara Boxer (D-CA) withdrew her amendment on rental recalls Dec. 14 during the Senate Commerce Committee's mark-up of the Auto Safety Bill.
The law, which was passed in 2005, had been challenged by the Association for the American Justice in September through a petition for review.
