Enterprise Owes $22.7M to Settle Lawsuit in Nevada

Settlement ends class action lawsuit regarding failure to include airport recovery concession fees in advertised rental cost.

Enterprise Leasing Company-West LLC and its subsidiary Vanguard Car Rental USA, operating the National Car Rental and Alamo Rent A Car brands, must pay $22.7 million to settle a class action lawsuit over airport recovery concession fees in Nevada.

Car rental companies operating on airports are required to pay a portion of their revenues to the airports, commonly called airport recovery concession fees. These fees are generally passed onto the customer. The lawsuit alleged that the rental companies did not include the fees in their advertised cost for rental cars but were itemized afterward, in violation of Nevada state law.

According to an article by Courthouse News Service, On Friday, May 15 U.S. District Judge Larry Hicks ordered the two companies to pay $19.3 million to the members, along with attorney's fees and legal costs, bringing the total potential cash settlement amount to $22,745,907.36.

A preliminary settlement was approved on Dec. 12, 2014.

The article stated that instead of cash, members can choose vouchers for free car rentals instead. The amount of vouchers members will receive is based on how much they paid in airport concession recovery fees.
