The parents of a deceased woman filed suit against Enterprise Rent-a-Car for letting a third party rent a vehicle for an unqualified driver, according to The Southeast Texas Record.

Leah and Jonathan Payne claim their daughter, Bethany Payne, was driving at an intersection on Dec. 2, 2008, when Glen Allen Keel III, who was driving a car from defendant Enterprise, struck her, reported the newspaper.

"As a direct and proximate cause of the Defendants' negligence herein, Bethany Payne was tragically and wrongfully killed," the suit filed Feb. 22 in Jefferson County District Court states.

When Enterprise rented out its vehicle, it knew Keel would not be authorized to drive the car, according to the lawsuit. The car rental company encouraged Keel to find another qualified person to rent the car for him, the lawsuit said.

The lawsuit does not state why Kent was not authorized to drive the car.

The Paynes claim that Enterprise acted negligently when it allowed defendant Bobby Green to rent the car for Keel. Because of Enterprise’s actions, Bethany Payne died, according to the complaint.

The Paynes are seeking an unspecificed judgment, plus interest, costs and other relief to which they may be entitled, reported the newspaper.
